Booking Conditions — Sa Blava (Spain)
Last updated: November 4, 2026
1. Who you are booking with
Sa Blava, a house in the hills above Tamariu (Palafrugell, Girona, Spain), is rented by its owner, Rare Retreat Villas [legal form and registered name, e.g. SARL / sole trader] (“the owner”, “we”), tax number [NIF / NIE of the owner]. A booking for Sa Blava is a contract directly between you and the owner.
Sa Blava is a tourist-use dwelling (habitatge d'ús turístic) registered in the Tourism Register of Catalonia under number HUT 014716 (Catalonia). Short-term rental registration number: [number from the Registro Único de Arrendamientos, if registered].
A stay at Sa Blava is a holiday stay under Catalan tourism law. It is not a residential tenancy, so the Spanish Urban Leases Act (Ley 29/1994) does not apply (article 5 e).
These conditions apply only to Sa Blava. Stays at Villa Mané in France follow our separate Terms & Booking Conditions.
2. The house and how many can stay
Sa Blava has 3 bedrooms and 3 bathrooms and sleeps a maximum of 7 guests, the capacity in its tourist registration. The house is rented as a whole, never by the room.
Only the guests named in the booking may stay overnight. The number of guests may not exceed the number booked without our written agreement.
Descriptions and photos are given in good faith. Small differences from what is shown are not grounds for a refund.
3. Price and payment
Prices are in euros and include VAT and every compulsory charge, except the Catalan tourist tax where it is shown separately (see section 4).
Full payment is made in advance. Your dates are only held once full payment is received. You receive a confirmation by email once payment is complete.
4. Catalan tourist tax
Catalonia charges a tax on stays in tourist accommodation, per person and per night, for guests aged 16 and over, on the first 7 nights of a stay. For tourist-use dwellings outside Barcelona the regional rate from 1 April 2026 is €1.75, plus any municipal surcharge set by Palafrugell. The owner collects it and pays it to the Catalan tax agency. [It is included in the price / It is charged separately on arrival.]
5. Guest registration and ID
Spanish law requires us to register every guest with the Catalan police (Mossos d'Esquadra) within 24 hours of arrival. Each guest must show a valid ID card or passport and give the details the law asks for before or at check-in. For minors, the adult responsible gives them.
We use this data only to meet that legal duty and keep it for the period the law requires (3 years). If the required details are not provided, we may have to refuse the stay.
6. Security deposit
A security deposit of [€ amount] is required. It is returned within [number] days after departure, less any amount needed to cover damage, breakage, missing items or exceptional cleaning. We will tell you in writing what was kept and why.
7. Cancellation
- Cancelled more than 30 days before arrival: full refund.
- Cancelled 30 days or less before arrival: no refund.
We recommend travel insurance that covers cancellation.
If we have to cancel your stay, you receive a full refund of everything you paid.
Under Spanish consumer law (article 103 l of Real Decreto Legislativo 1/2007), the 14-day right of withdrawal does not apply to accommodation booked for specific dates.
8. Arrival, departure and help during your stay
Check-in is from [time] and check-out is by [time], unless agreed otherwise.
For any problem during your stay, call or message [phone number for guests during the stay]. This number is also displayed at the house, together with the registration number and maximum capacity, as Catalan law requires.
9. House rules
Written house rules are provided at the house in Catalan, Spanish, English and French. In short:
- No smoking inside the house.
- No parties or events. Respect the rest of neighbours and keep noise down at night.
- Pets are welcome. Tell us when you book. You are responsible for your pet's behaviour, any damage it causes and cleaning up after it.
- Sa Blava is surrounded by pine forest. Lighting fires in or near forest land is banned in Catalonia from 15 March to 15 October, and fire rules can be tightened on high-risk days. Use only the equipment provided, as instructed, and never throw cigarettes outside.
- Leave the house in a reasonable state: wash up, empty the fridge, take the rubbish to the bins.
- Nothing may be damaged, broken or taken.
If guests seriously break these rules, we may ask them to leave the house, as Catalan tourism rules allow.
10. Pool
The pool is not supervised. Children must be watched by an adult at all times near the water. Guests use the pool at their own risk and must follow the safety instructions at the house.
11. Damage and liability
You are responsible for any damage caused during your stay by you, your group or your pets. We recommend holiday liability insurance.
The owner is not liable for the loss or theft of guests' belongings, except where the law requires otherwise.
12. Complaints
If something is wrong, tell us straight away at vincent@hk97vince.com or [phone number for guests during the stay] so we can fix it.
Official complaint forms (fulls oficials de queixa, reclamació i denúncia) are available at the house and on request, as the Catalan Consumer Code (Llei 22/2010) requires. You can also contact the Agència Catalana del Consum or file a complaint about a tourist establishment with the Generalitat de Catalunya. Where both sides agree, a dispute can go to the Junta Arbitral de Consum de Catalunya.
13. Applicable law and courts
These conditions are governed by Spanish law and, where it applies, Catalan law. If you are a consumer living in another country, you keep the protection of the mandatory rules of your country of residence, and you can bring a claim in the courts where you live.
